Terms and Conditions for Viktoriia Panova — Psychology Practice

Welcome to Viktoriia Panova — Psychology Practice ("the App"). These Terms and Conditions ("Terms") govern your use of the App developed by Smbat Siradeghyan ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility and Use of the App

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the App. If you are under 18, you must have parental or guardian consent.
The App is intended for personal, non-commercial use only.
You agree not to copy, modify, distribute, sell, lease, or reverse engineer any part of the App.
You may not use the App for any unlawful purpose or in violation of these Terms.

2. User Content and Conduct

You may not upload, post, or distribute content that is unlawful, defamatory, offensive, infringing, or violates any third-party rights.
We reserve the right to remove content, suspend, or terminate access for users who violate these Terms without prior notice.
You are solely responsible for any content you create or share through the App.

3. Intellectual Property

All content, including but not limited to puzzles, graphics, logos, text, software, and design elements, is the exclusive property of Smbat Siradeghyan or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use. This license does not grant you any ownership rights to the App or its content.

4. In-App Purchases

The App may offer optional in-app purchases for additional features, content, or virtual items.
All purchases are processed through the platform provider (Apple App Store, Google Play Store, etc.) and are subject to their respective terms and policies.
In accordance with EU and Polish consumer protection laws, you have the right to withdraw from a purchase within 14 days. However, by using digital content immediately after purchase, you waive this right as permitted under Article 38(13) of the Consumer Rights Directive.
Prices are subject to change without notice. All prices include applicable VAT as required by Polish law.
You are responsible for any charges incurred on your account, including unauthorized purchases made by others using your device.

5. Privacy and Data Collection

Your privacy is important to us. We collect and use your personal information in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR) and Polish data protection laws.

By using the App, you consent to our data practices as described in the Privacy Policy. You have rights under GDPR including access, rectification, erasure, and data portability.

6. Third-Party Services

The App may integrate with or contain links to third-party services, websites, or content. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

7. Disclaimer of Warranties

To the extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We do not guarantee:

The accuracy, completeness, or quality of any content, including puzzles or game elements
Uninterrupted, secure, or error-free operation of the App
That defects will be corrected
That the App is free of viruses or other harmful components

Note: Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Polish or EU law.

8. Limitation of Liability

To the maximum extent permitted by Polish and EU law:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability for any claims shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or 500 PLN, whichever is greater.

Important: This limitation does not apply to liability that cannot be excluded under mandatory provisions of Polish or EU law, including liability for intentional misconduct, gross negligence, death, or personal injury.

9. Indemnification

You agree to indemnify and hold harmless Smbat Siradeghyan from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any rights of another party
Any content you submit or share through the App

10. Account Termination and Suspension

We reserve the right to suspend, restrict, or terminate your access to the App for violations of these Terms or applicable law. Upon termination:

Your right to use the App immediately ceases
We will handle your personal data according to GDPR requirements and our Privacy Policy
Purchased content may become inaccessible, subject to applicable consumer protection laws

11. Changes to the Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Update the "Effective Date" at the top of this page
Notify you through the App or via email at least 30 days before changes take effect (as required for consumer contracts)
Provide you the opportunity to review and accept updated Terms

If you do not agree to the changes, you may terminate your use of the App.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland and the European Union, without regard to conflict of law provisions.

For Consumers:

If you are a consumer residing in the EU, nothing in these Terms affects your rights under mandatory consumer protection laws.
You have the right to bring disputes before the courts of your place of residence.
You may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

Dispute Resolution Process:

Informal Resolution: We encourage you to contact us first to seek an informal resolution within 30 days.
Mediation: If informal resolution fails, we can attempt mediation through a recognized mediation service.
Court Proceedings: Disputes may be brought before the competent courts in Poland. EU consumers may choose courts in their country of residence.

13. EU Consumer Rights

If you are a consumer in the European Union, you have specific rights under EU consumer protection legislation:

Right to clear and transparent information about products and services
Right to withdraw from distance purchases (subject to digital content exceptions)
Right to remedies for defective products
Protection against unfair commercial practices

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under Polish or EU law, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smbat Siradeghyan regarding the App.

16. Language

These Terms are provided in English. In case of any dispute regarding interpretation, the English version shall prevail, unless otherwise required by applicable law.
